Mr. Davis has a wide range of experience in litigation matters and as an appellate advocate. He has defended employers against a variety of individual plaintiff and class-based claims, including race, age, disability, and gender discrimination, Whistleblower’s Protection Act, Fair Labor Standards Act, False Claims Act, breach of contract, and general business tort claims. He has also defended suits against pharmaceutical companies, hospitals, and physicians.

Prior to joining Kienbaum Opperwall Hardy & Pelton, Mr. Davis was an associate attorney at the Jones Day law firm in Washington, D.C., in a practice group dedicated to appeals and difficult legal issues. Mr. Davis also served as a law clerk to the Honorable Bruce M. Selya of the U.S. Court of Appeals for the First Circuit. He graduated summa cum laude from Indiana University School of Law – Bloomington, and was selected to join the Order of the Coif.

Practice Highlights

  • Authored the appellate brief that led to affirmance of ruling that the FLSA did not require the client to provide paid meal breaks for security employees.
  • Obtained a stipulated dismissal of class-related claims of age, race, and gender discrimination brought against a major accounting firm.
  • Defended a national insurance company on appeal, securing affirmance of a favorable jury verdict and judgment on Title VII and Michigan Civil Rights Act retaliation and discrimination claims.
  • Represented a Fortune 500 retail chain against False Claims Act retaliation, national-origin discrimination, and wage-violation claims.
  • Obtained summary judgment on alleged misappropriation of trade secret and breach-of-contract claims brought against a start-up company and its founder.
  • Represented hospital and pharmaceutical clients against allegations of False Claims Act violations.
