Biography

Mr. Boger has successfully defended a spectrum of management clients in state and federal courts and before administrative agencies. He has extensive experience litigating EEO issues, such as claims of age and pregnancy discrimination, sexual and racial harassment, claims under the ADA, FMLA, and whistleblower laws, as well as employment contract claims. He has counseled clients on matters under the FLSA and defended ERISA employer contribution claims filed by union trust funds.

In addition, Mr. Boger has special knowledge of the appellate process having worked for the Michigan Court of Appeals at the outset of his career as an attorney in the Court’s Pre-Hearing Division and then for two years as clerk to the Honorable Brian K. Zahra. While in private practice, Mr. Boger has handled appeals in numerous employment and labor cases in the Michigan Court of Appeals, Michigan Supreme Court, and the U.S. Court of Appeals for the Sixth Circuit.

Some of Mr. Boger’s representative engagements include:

  • Obtaining summary judgment and an award of costs against a plaintiff who had alleged disability discrimination and retaliation by a prominent financial services firm.
  • Successfully representing a Fortune 500 automotive finance company against a nine-plaintiff age discrimination suit that turned on expert statistical evidence.
  • Representing a national “big box” retailer in connection with a wide range of ADA issues, including claimed mental impairments, back and shoulder injuries, and lifting restrictions.
  • Successfully defending a Fortune 500 telecom company against disability claims related to alleged pregnancy complications.
  • Obtaining dismissal of a sexual harassment lawsuit against a major restaurant-brewery that focused on videotape evidence.


Mr. Boger graduated summa cum laude from the University of Detroit Mercy School of Law in 1998, where he served as an editor of the Law Review and was a three-year Jerome P. Cavanagh Merit Scholarship recipient. Mr. Boger earned his undergraduate degree in business administration, with honors, from Michigan State University in 1995, having studied law abroad at the University of Cambridge, England.
